Judge Jon S. Tigar

Jon Steven Tigar was born in October 1962 in London, England. He earned an undergraduate degree from Williams College and a Juris Doctor from the University of California Berkeley School of Law. He clerked at the Eleventh Circuit U.S. Court of Appeals, before entering into the private practice of law.
Tigar served two years as a public defender in San Francisco. He returned to private practice. He served as a judge on the Alameda County Superior Court. He was an elected member of the American Law Institute and also taught pretrial litigation at UC Berkeley School of Law. He was a member of the California Judicial Council’s Advisory Committee on Civil Jury Instructions and the Ninth Circuit’s Jury Instructions Committee.
Tigar was nominated by President Barack Obama to be a judge on the United States District Court for Northern California. His confirmation was by the unanimous consent of the Senate and he received his commission in January 2013.

Northern California District Judge Jon Tigar determined that the city of San Francisco is not immune to claims of fostering a nuisance under state law. Plaintiffs claim that the city has violated equal protection rights and disability laws by letting tents and people fill the sidewalks.
The judge acknowledged that the city’s actions had created danger for the plaintiff under the California Disabled Persons Act.
“Plaintiffs’ amended complaint, however, now alleges affirmative conduct on the part of the city,” Judge Tigar wrote. “Thus, ‘if and when the court considers remedies, the appropriate relief may be as simple as ordering the city to cease engaging in certain activities.'”
The judge rejected the city’s claim of immunity due to carrying out the Emergency Services Act during the pandemic. He wrote, “It is not clear from the face of the complaint or the judicially noticed documents that any of the allegations which plaintiffs’ claims rest relate to either of the emergencies.”
